Abstract
I to sentrale dommer, Anne Lene Lie-dommen (Rt. 1998 s. 1565) og Ask-dommen (Rt. 2010 s. 1547), er det utviklet fire kriterier for å konstatere årsakssammenheng mellom bilpåkjørsler og nakkeslengskade. Det ble slått fast at vurderingen av årsakssammenheng etter nakkeslengskader skal vurderes i lys av de fire Lie-kriteriene. Disse fire vilkårene bygger på at en nakkeslengskade er en traumatisk påført fysisk bløtdelsskade. Oppgavens hovedproblemstilling er i hvilken utstrekning man kan anvende disse fire kriteriene på andre bløtdelsskader enn nakkesleng. Oppgaven tar for seg både juridiske og medisinske problemstillinger.
In two key judgments, Anne Lene Lie (Rt. 1998 page 1565) and Ask (Rt. 2010 page 1547), the Norwegian Supreme Court established four criteria that has to be fulfilled to establish causation between car accidents and whiplash. The Supreme Court ruled that the assessment of causation by whiplash injuries should be evaluated in light of the four so-called Lie-criteria . These four criteria are based on that a whiplash injury is a traumatic inflicted physical soft tissue damage. The main thesis in this article is to evaluate to what extent one can apply these four criteria on other soft tissue injuries than whiplash. This thesis discusses both legal and medical aspects.
